Local Law and Subordinate Local Law Amendments

Consultation has concluded


Mackay Regional Council (“council”) has resolved to propose amendments to the following local laws and subordinate local laws (“proposed amended local laws”):

Local Law No. 3 (Community and Environmental Management) 2011; Subordinate Local Law No. 1.4 (Installation of Advertising Devices) 2011; Subordinate Local Law No. 1.10 (Operation of Public Swimming Pools) 2011; Subordinate Local Law No.2 (Animal Management) 2011; Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2011; and Subordinate Local Law No. 5 (Parking) 2011.

The purpose and general effect of the amendments to the proposed amended local laws are:

1. Local Law No. 3 (Community and Environmental Management) 2011, to modify the grounds for determining when an allotment is overgrown or unsightly

2. Subordinate Local Law No. 1.4 (Installation of Advertising Devices) 2011, to modify requirements for particular advertising devices

3. Subordinate Local Law No. 1.10 (Operation of Public Swimming Pools) 2011, to reflect the new water quality guidelines for public aquatic facilities released by Queensland Health

4. Subordinate Local Law No. 2 (Animal Management) 2011, to include new off-leash and prohibited areas for dogs and amend the conditions in which animals must be kept.

5. Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2011, to include additional local government-controlled areas, facilities and roads

6. Subordinate Local Law No. 5 (Parking) 2011: To amend off-street regulated parking areas and make incidental corrections for legislative consistency.

Council invites the public to provide written submissions on the proposed amended local laws for a period of 31 days commencing on Friday, January 8 and ending on Sunday, February 14, 2021 at 11:59pm (“consultation period”).

Written submissions may be made by any person supporting or objecting to the proposed amended local laws and must be given to council on or before the last day of the consultation period, stating the grounds of the submission and the facts and circumstances relied on in support of the grounds. Submissions given to council after the end of the consultation period may not be considered by council. Copies of the proposed amended local laws are available from council’s offices or to the right of this web page, along with a review of anti-competitive provisions.

Submissions may be provided to council through the below feedback form, delivered by email to governance.enquiry@mackay.qld.gov.au, posted to Mackay Regional Council, PO Box 41, Mackay Qld 4740, or by hand-delivery to Sir Albert Abbott Administration Building, 73 Gordon Street, Mackay.
