Consultation determined that the community still utilises the reserve land for its intended purpose and that most respondents objected to the land being sold for private use. As the community has demonstrated a need for the land to remain a Reserve for Parks and Recreation, council has decided not to support an application being made to the Department of Resources by the owner/s of 31 Cabbage Tree Road, Andergrove, to purchase a portion of the reserve land. Mackay Regional Council has received a request from the owners of 31 Cabbage Tree Road, Andergrove to make an application to the Department of Resources to purchase an area of reserve land at 17 Sutton Court, Andergrove which adjoins their property.
The land area proposed to be purchased is approximately 533m2 and is owned by the Department of Resources, with council acting as trustee to the land.
Please refer to the map attached for details on the area of reserve land to be purchased.
The applicant has indicated the proposed use for the land will be a lay down area or shed (for use in conjunction with business operations).
All relevant council programs have considered the request and offered no objection to the making of the application, with the conditions that:
The existing shared path between Sutton Court and Cabbage Tree Road be retained by the Department of Resources, with council acting as trustee.
Any future applications for the development of the reserve land proposed to be purchased will be Code Assessable.
The existing garden bed (including edging and irrigation) will be removed by the applicant and the area returfed at the cost of the applicant.
All existing services will be protected during fence construction.
The community's feedback is sought on this application.
